What Are The Rights of Homeless Students?
Go to school, no matter where they live or how long they have lived there. They must be given access to the same public education, including preschool, provided to the other children.
Continue in the school they last attended before they became homeless or the school they last attended, if that is the parent’s or youth’s choice and if feasible.
Receive transportation to the school they attended before the family or youth became homeless or the school they last attended, if the parent or youth request such transportation.
Enroll in school without giving a permanent address. Schools cannot require proof of residency that might prevent or delay school enrollment.
Enroll and attend classes while the school arranges for the transfer of school and immunization records or any other documents required for enrollment.
Receive the same special programs and services, if needed as provided to all children or youth served in these programs.
What Are The Rights of Parents of Homeless Students?
The right to choose which school the child will attend (either the home school or the school nearest the shelter, whichever is in the best interest of the child).
The right to appeal if a school refuses to admit a child or a school refuses to keep a child enrolled. (Enrollment means attending classes and participating fully in school activities).
The right to a written explanation from the school regarding enrollment disputes.
The right to seek the assistance of liaisons, advocates or attorneys.
The right to receive tutoring or remedial assistance for their children.
The right for their children to attend any school programs that are offered to other children.
Return to school in a regular school program after a period of absence (up to age 21).
